MERC Partners ('the Company') is committed to protecting the privacy of your information. We understand that the privacy and the security of personal information is very important to you. The purpose of our Privacy Policy is to outline the Company's practices in this area.

Candidate Data Protection Policy
The candidate acknowledges that the details supplied by him/her and any information about him/her, including CVs, profiles, references or any other information which arises from the conduct of or in connection with the foregoing contains personal data within the meaning of the Data Protection Act 1988 (as amended) which will be used by the Company and/or any of its subsidiaries and successors to provide the advise and employment services and for group reporting and management purposes. The candidate hereby consents to the processing of such details being carried out by the Company and/or any of its subsidiaries and successors or on its or their behalf by its or their agents and service providers.
The candidate expressly consents to the transmission and processing of information and data necessary for the advise and employment services outside of Ireland and the European Economic Area, including the transmission to and processing of such information and data by the Company, its partners and their subsidiaries and successors, affiliates or contractors in other countries (including the countries in which clients have offices branches, headquarters or subsidiaries or where advise and employment services are to be performed).
 
The candidate shall indemnify the Company against any loss or damage which the Company may sustain or incur as a result of any breach by candidate of the provisions of this policy.
 
The Company, its partners and their subsidiaries and successors are hereby authorised to disclose information relating to the advise and employment services or any details or personal data held in relation to such advise and employment services to any person acting as their agent or to any third parties engaged by them in connection with such advise and employment services.
The candidate hereby consents to the such information being used by the Company and its subsidiaries and successors to provide the candidate with information by way of direct marketing about other products and services supplied or arranged by them, either themselves, or through their associated companies, assigns or in their capacity as an independent broker or which are in any other way howsoever arranged by them with a third party.
 
Please note that this policy entitles the Company and its subsidiaries and successors to use such information to provide candidates with information by way of direct marketing and/or in relation to future possible roles and positions.  If you do not wish to receive such information, please notify the Company at MERC Partners, 11/12 RichviewOffice Park, Clonskeagh, Dublin 14.
 
If you subsequently decide you no longer wish to receive such information, please notify the Company at MERC Partners, 11/12 RichviewOffice Park, Clonskeagh, Dublin 14.
The fact that you choose not to receive such information will not affect any aspect of the facilities and services that the Company and its subsidiaries and successors provide to you now or in the future.
 
Remember, (subject to paying any applicable fee) you have the right to obtain a copy of all personal data relating to you which is held by the Company and its subsidiaries and successors and to have any inaccuracies in that data corrected.
 
Client Data Protection Policy
 
The following expressions have the following meanings:
 
'Confidential Information' means non-public information that the Company designates as being confidential or which, under the circumstances surrounding disclosure ought to be treated as confidential. 'Confidential Information' includes, without limitation, information relating to the Company and its services and opportunities, personal data, technical knowledge, know-how, formulae, processes, techniques, data and data systems, plans, specifications, drawings, products, customers, supplies, markets, sales, prices, accounts, finances, forecasts, projections, prospects, organisation, business, policies, practices, transactions or other affairs of the Company, the marketing or promotion of any the Company product, the Company's business policies or practices, and information received from others that the Company is obligated to treat as confidential. Confidential Information disclosed to the client by the Company subsidiary and/or agents is covered by this agreement.
 
'Materials' means all materials and media containing or comprising Confidential Information, or on which Confidential Information is stored or resides, including without limitation, written or printed documents and computer disks, CDs, tapes or other media and whether machine or user readable.
 
The client agrees and warrants:
 
  • that it shall keep and process the Confidential Information and candidate personal data only in compliance with applicable data protection law;
  • that it has implemented the technical and organizational security measures before processing the personal data, namely those measures aimed at protecting personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, in particular where the processing involves the transmission of data over a network, and against all other unlawful forms of processing;
  • that it shall promptly notify the Company about any accidental or unauthorised access and any request received directly from the data subjects without responding to that request, unless it has been otherwise authorised to do so;
  • to deal promptly and properly with all inquiries from the Company relating to its processing of the personal data;
  • at the request of the Company to submit its data processing facilities for audit of the processing activities which shall be carried out by the Company or an inspection body composed of independent members and in possession of the required professional qualifications bound by a duty of confidentiality, selected by the Company, where applicable;
  • that it is compliant with applicable data protection law and will indemnify the Company against all costs, claims, liabilities and demands arising out of such non-compliance or any breach by it of its obligations;
  • that it has obtained all necessary consents from individuals whose personal data, the client supplies to the Company;
  • that it has not received any notice from either the Data Protection Commissioner or a data subject alleging non-compliance with applicable data protection law or prohibiting the transfer of data nor has any individual claimed or will have the right to claim compensation from the client under applicable data protection law for loss or unauthorised disclosure of data;
  • that to the extent that any information or data provided by it or on its behalf to the Company or Company subsidiaries for the purposes of the Company or its subsidiaries or contractors performing the services, comprises personal data, that such personal data will have been obtained, and that the provision of such personal data the Company or its affiliates or contractors for such purposes will be, in compliance with all relevant applicable data protection law. The client expressly consents to the transmission and processing of information and data necessary for the services outside of Ireland and the European Economic Area, including the transmission to and processing of such information and data by the Company and /or its subsidiaries or contractors in other countries where Candidates may be located or where services are requested to be performed.
 
All personal data, Confidential Information and Materials are provided 'as is' without warranty of any kind. The client agrees that neither the Company nor its suppliers shall be liable for any damages whatsoever relating to the client's use of such personal data, Confidential Information and Materials.
